
| Background I started a Doctor of Engineering (D. Eng) degree study in Civil and Environmental Engineering with specialization in Engineering and Project Management in August of 2003. I was the only black doctorate students, and the only Doctor of Engineering student in the 2003/2004 class of Engineering and Project Management Group of Civil & Environmental Engineering Department at the University of California at Berkeley. |

| 1. Failure to Provide Academic Advisor As a first year doctorate student I was never appointed an advisor and was not provided any academic advising deserved of a first year doctorate student. Page 1 of the attached exhibits is a list of student advisory list provided by the University in defence of this allegation. On that list, you will notice that my name was not originally included in the list of expected students. I had to write in my name at the orientation and followed up with a formal request for academic advising; see page 2 of the exhibits. You will notice that two or three European exchange students checked in after me, and equally hand written their names on the list. The only difference is that they are white, and they were all provided advisor even though their name came in below my name on the list. My request for academic advising was ignored and instead of appointing me tenured faculty as an advisor,the University of California at Berkeley and Iris D. Tommelein listed my national origin (Nigeria) as my advisor! In that school year, I was rejected, ignored and humiliated, I basically had to grind out the school year without any form of academic mentoring . On March 10, 2004 (Barely six weeks into the end of the school year) Professor Iris D. Tommelein sent me an email requesting to know who has been advising me. (see page 3, of the exhibit.) I met with the Professor Tommelein to discuss this situation on March 11, 2004 and it turned out that Professor Tommelein had only used the lack of advisor as a means of getting my ears when she most needed them. The meeting lasted only 2 minutes and 45 seconds, and Professor Tommelein delivered her promise to stop me from the doctorate program. “KIKI YOU CANNOT, AND WILL NOT, GET A PhD FROM THIS SCHOOL, NO, IT WILL NOT HAPPEN”! 2. Deprivation of Equal Education Opportunity in Testing and Examination On May 10, 2004 there was the normal end of the year comprehensive examination. The examination was intentionally and purposely directed towards Masters and Doctor of Philosophy (PhD) students only to the exclusion of the only Doctor of Engineering Student in the class. No questions were provided for the only Doctor of Engineering student who also happens to be the only black male student of Nigerian origin in the class. See pages 4 and 5 of the attached Exhibits for a copy of the examination questions provided by Iris D. Tommelein,. You will notice on page 6 of the Exhibits that I was admitted as a doctor of engineering student. I did not requested to be reclassified, and was not reclassified as a PhD student during the school year. Sometime in June of 2004, I received a dismissal letter (exhibits at page 7) from Professor Iris D. Tommelein in fulfillment of her initial promise, and in violation of section E 2.1 of the guide to graduate policy of the University of California at Berkeley. The only reason cited in that letter is an alleged failure of the comprehensive examination where I was not provided any question as a Doctor of Engineering (D. Eng) student. 3. The University of California at Berkeley Supports & Justify Discrimination I initiated a University Graduate appeal process to overturn the unlawful dismissal. Despite the fact that Iris D. Tommelein testified during the appeal process that a Doctor of Engineering student is not required to take the comprehensive examination for which cause I was wrongfully dismissed me from the University, the University of California at Berkeley ratified Professor Tommelein's decision, and denied my request to be reinstated to graduate standing. (See exhibits at Page 9 for the testimony of Iris D. Tommelein with the fact finder). On page 10 of the exhibits, the University of California at Berkeley denied my request to be reinstated to graduate standing after the testimony that I was not required to take the comprehensive examination. Concerning lack of academic advisor, the University of California at Berkeley covered up for Iris D. Tommelein, saying that Iris D. Tommelein was appointed as my advisor but I was not informed of her appointment, and that the University is not even required to appoint me an advisor, see pages 11 of the Exhibit. This statement is at variance with the University of California at Berkeley's policy on appointment of academic advisors, see page 12 of the Exhibit for a copy of the University policy on graduate student advisor. Also, the University of California at Berkeley concluded that the provision of academic mentoring similar to those enjoyed by other students is not applicable to me. See Item 3 of Ilan Adler's recommendation on page 10 of the exhibits. Dehumanization
At this time, I am aware that Professor Bea is vigorously denying this allegations. I want you to please ignore the incoherent and contradictory denials coming from both Professor Bea and the University of California at Berkeley. I posted this Bea Lied document to provide you an insight into the true personality of professor Bea. After reviewing this document, I am sure you will be able to decided who, and what to belief. I am amazed that Professor Bea betrayed the truth and fairness duty bestowed on him as a member of the National Academy of Engineers. You will agree with me that anyone who can deny a document with his electronic autograph is not trustworthy and is capable of denying any spoken word. The University of California at Berkeley Supports the Dehumanization of Black Students by White Professors When I appealed to the University of California at Berkeley, the fact finder concluded that those charges of harassment, oppression and dehumanization are tangential to his course, therefore, he did not investigate them. Most importantly, the fact finder concluded that Professor Bea provided him plausible reason for making those coup plot statements. . EXHIBITS |
